"JLA FORUMS "TERMS OF SERVICE"

General Use Restrictions

JLA ENTERPRISES ("JLA") provides an interface with which you may choose to view third party text, image and video files posted to USENET servers around the world ("Third Party Content"). Some content also originates at the JLA FORUMS and is considered ("Third Party Content") as well. JLA does not monitor or control Third Party Content to USENET. Third Party Content may be subject to copyright protection and other restrictions imposed by the owner of the copyright to such content. To view available contact information for the party that posted a particular item, follow the USENET Header Information described below. You are solely responsible for determining whether your use of Third Party Content is lawful. For content originating at the JLA FORUMS, contact the site administrator at info@jlaenterprises.com for content origination information.

Conduct.

You agree not to post, email, or otherwise make available any content:

a) that is abusive, obscene, vulgar, slanderous, hateful, harmful, threatening, abusive, libelous, harassing, defamatory, invasive of another's privacy, harmful to minors in any way, illegal sexually-oriented or any other material that may violate any applicable law;

b) that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;

c) that violates the Fair Housing Act by stating, in any notice or ad for the sale or rental of any dwelling, a discriminatory preference based on race, color, national origin, religion, sex, familial status or handicap (or violates any state or local law prohibiting discrimination on the basis of these or other characteristics);

d) that violates federal, state, or local equal employment opportunity laws, including but not limited to, stating in any advertisement for employment a preference or requirement based on race, color, religion, sex, national origin, age, or disability.

e) with respect to employers that employ four or more employees, that violates the anti-discrimination provision of the Immigration and Nationality Act, including requiring U.S. citizenship or lawful permanent residency (green card status) as a condition for employment, unless otherwise required in order to comply with law, regulation, executive order, or federal, state, or local government contract.

f) that impersonates any person or entity, including, but not limited to, a JLA employee, or falsely states or otherwise misrepresents your affiliation with a person or entity (this provision does not apply to Content that constitutes lawful non-deceptive parody of public figures.);

g) that includes personal or identifying information about another person that is not publicly available without that person's explicit consent;

h) that is false, deceptive, misleading, deceitful, misinformative, or constitutes "bait and switch";

i) that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or Content that you do not have a right to make available under any law or under contractual or fiduciary relationships;

j) that constitutes or contains "affiliate marketing," "link referral code,"  "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement;

k) that constitutes or contains any form of advertising or solicitation if: posted in areas of the JLA FORUMS which are not designated for such purposes; or emailed to JLA FORUMS users who have not indicated that it is ok to contact them about other services, products or commercial interests.

l) that advertises any illegal service or the sale of any items the sale of which is prohibited or restricted by any applicable law, including without limitation items the sale of which is prohibited or regulated by North Carolina law.

m) that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

o) that disrupts the normal flow of dialogue with an excessive amount of Content (flooding attack) to the Service, or that otherwise negatively affects other users' ability to use the Service; or

p) that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of Content transmitted through the Service.

Additionally, you agree not to:

q) contact anyone who has asked not to be contacted;

r) "stalk" or otherwise harass anyone;

s) collect personal data about other users for commercial or unlawful purposes;

t) use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from or post to the JLA FORUMS - unless expressly permitted by the JLA FORUMS;

u) post non-local or otherwise irrelevant Content, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on our infrastructure;

v) post the same item or service in more than one category or forum, or in more than one metropolitan area;

w) attempt to gain unauthorized access to JLA's computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service or the JLA FORUMS website; or

x) use any form of automated device or computer program that enables the submission of postings on the JLA FORUMS without each posting being manually entered by the author thereof (an "automated posting device"), including without limitation, the use of any such automated posting device to submit postings in bulk, or for automatic submission of postings at regular intervals.

Posting Agents

A "Posting Agent" is a third-party agent, service, or intermediary that offers to post Content to the Service on behalf of others. To moderate demands on JLA's resources, you may not use a Posting Agent to post Content to the Service without express permission or license from JLA. Correspondingly, Posting Agents are not permitted to post Content on behalf of others, to cause Content to be so posted, or otherwise access the Service to facilitate posting Content on behalf of others, except with express permission or license from JLA.

ANONYMIZERS AND PROXY SERVERS

You are not permitted to use the JLA FORUMS from any ANONYMIZER service.  You are not permitted to use the JLA FORUMS from any PROXY SERVER which places and unusual demand on JLA's resources.  If we find that you are accessing the JLA FORUMS from either an ANONYMIZER SERVICE or a PROXY SERVER, we may terminate your account without notice per the "Termination Of Service" section below.

Termination Of Service

You agree that JLA, in its sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the JLA FORUMS (or any part thereof), immediately and without notice, and remove and discard any Content within the JLA FORUMS, for any reason, including, without limitation, if JLA believes that you have acted inconsistently with the letter or spirit of the TOS. Further, you agree that JLA shall not be liable to you or any third-party for any termination of your access to the JLA FORUMS. Further, you agree not to attempt to use the JLA FORUMS after said termination.

Other Items Of Importance

While the administrators and moderators of this forum will attempt to remove or edit any generally objectionable material as quickly as possible, it is impossible to review every message or all posted content unless the message or content is reported. Therefore you acknowledge that all posts made to these forums express the views and opinions of the author and not those of JLA ENTERPRISES, the administrators, moderators or webmaster and hence will not be held liable.

To manage the size of our database, all accounts of registered members that have not logged into the site for over 1 year (360 days) will be deleted. If this happens all messages in your mailbox and other member related items/information may be deleted. Once your account is deleted, there is no way to restore it or recover your information. You will have to re-register. Be sure to login at least once every 360 days to prevent your account from being deleted.

You agree to receive all e-mail announcements and notifications from the JLA FORUMS to the e-mail address you entered when registering.

This forum system uses cookies to store information on your local computer. These cookies do not contain any of the information you have entered above; they serve only to improve your viewing pleasure. Your registered e-mail address is used only for confirming your registration details and password in addition to any other stated provision in this agreement as well as sending email announcements, notifications and new passwords should you forget your current one.

You agree that the webmaster, administrator and moderators of this forum have the right to remove, edit, move or close any topic at any time should they see fit. As a user you agree to and understand that any information you have enter will be stored in a database. While registration information will not be disclosed to any third party without your consent (unless required by law or allowed by other terms of this agreement.) - the webmaster, administrator and moderators cannot be held responsible for any hacking attempt that may lead to the data being compromised. You agree and understand that any postings you make will be available to anyone that visits the JLA FORUMS (unless it is in an USERGROUP membership required or "SUBSCRIPTION" forum/section - in those cases the postings will only be available to individuals granted access to those forums/sections.) You agree and understand that your registered e-mail address will become available (addresses will contain extra characters to thwart attempts of e-mail harvesters/spammers) with any of your postings to forums that are synchronized with the USENET. JLA FORUMS "SUBSCRIPTION" or USERGROUP membership required forums are NOT synchronized "OUT" to the USENET. For information on which groups are synchronized, contact the JLA FORUMS Administrator.

No Endorsement

JLA does not endorse, support, represent or guarantee the truthfulness, accuracy, or reliability of Third Party Content or any associated information. You acknowledge that any reliance on Third Party Content is at your own risk.

Third Party Interaction

In your use of the Site you may enter into correspondence with, purchase goods and/or services from, or participate in promotions of, third parties that advertise on this site. Unless otherwise stated in writing by JLA, any such correspondence, purchase or promotion, including the delivery of and the payment for goods and/or services, and any other term, condition, warranty or representation associated with such correspondence, purchase or promotion, is solely between you and the applicable third party. You agree that JLA has no liability, obligation or responsibility for any such correspondence, purchase or promotion between you and any such third party.

This Site contains links to other websites that are not under the control of or maintained by JLA. Such links do not constitute an endorsement by JLA of those websites. You acknowledge that JLA is providing these links to you only as a convenience. JLA is not responsible for the content of such websites. Your use of other websites is subject to the terms of use and privacy policies located on the linked websites.

Restricted Areas of the Site

Certain functions of the Site are restricted to authorized users or require you to provide personal information ("Restricted Areas"). You are entirely responsible for maintaining the confidentiality of your password and your account information, if any, and agree to notify JLA if the password is lost, stolen, disclosed to an unauthorized third party, or otherwise may have been compromised. You agree that you are entirely responsible for any and all activities which occur under your account, including, without limitation, any fees which may be incurred under your password-protected account, whether or not you are the individual who undertakes such activities. You agree to immediately notify JLA of any unauthorized use of your account or any other breach of security in relation to the Site known to you.

Fees

Many sections of the JLA FORUMS are accessible FREE OF CHARGE.   Some sections require a paid SUBSCRIPTION. You will not be able to view these sections or access them until you enter into a SUBSCRIPTION AGREEMENT. Your current subscription information is located in the "Groups" and "Transactions" section of the Site. You may cancel your account at any time in these sections. You agree to pay the subscription fees and any other charges incurred in connection with your user name and password at the rates in effect when the charges are incurred. JLA's payment processor will bill all charges automatically to your credit card. Subscription fees will be billed at the beginning of your subscription and upon any reoccurring renewal. All fees and charges are nonrefundable. If you want to use a different credit card or there is a change in credit card validity or expiration date, you must change your account information with JLA's payment processor or cancel your subscription and sign up again. Your subscription may be cancelled and your JLA FORUMS account may be terminated without warning if we believe anyone but the account holder has accessed your JLA FORUMS account. If your subscription is cancelled or your JLA FORUMS account is terminated/cancelled, any paid subscription fees are non-refundable. Unauthorized Activities

You acknowledge that JLA is only providing you with an interface through which you can access USENET and other Third Party Content. You are responsible for determining and complying with all applicable laws and regulations. You are wholly responsible for your actions or the actions of any person using your screen name, account or password. As such, you agree to hold JLA entirely harmless from and against any and all costs, damages, liabilities, and expenses (including attorneys' fees) incurred by JLA in relation to, arising from or for the purpose of avoiding any claim or demand from a third party that your use of the Site or the use of the Site by any person using your screen name, account or password violates any applicable law or regulation, or the rights of any third party. JLA DOES NOT TOLERATE UNDER ANY CIRCUMSTANCES THE POSTING OF ANY ILLEGAL MATERIAL OF ANY KIND, ESPECIALLY CHILD PORNOGRAPHY! Spam

JLA encourages you to use our service as long as you abide by our Terms Of Service and JLA's prohibition on spamming and unethical marketing activities. The following are some examples of spamming that may violate the Terms of Service and JLA's Universal Spam Policy:

• Manipulating identifiers, such as email headers, to disguise the origin of any content transmitted to or through JLA's computer systems.

   

• Relaying email from a third party's mail servers without the permission of that third party.

   

• Using or causing to be used JLA's computer systems to facilitate the transmission of unsolicited or unauthorized material. This includes any promotional materials, URLs, "junk mail," "chain letters," "pyramid schemes," or any other form of unauthorized solicitation that you may upload, post, email, transmit, or otherwise make available.

   

• Using "robots" or otherwise harvesting other's email addresses from the JLA's for purposes of sending unsolicited or unauthorized material.  Using of "robots"

   

• Uploading, posting, emailing, or transmitting the same message, URL, or post multiple times.

Adult Use Only

If you are under the age of 18 you are not permitted to use the site.

Trademarks

All JLA trademarks, names, service marks and logos displayed on the Site are the property of JLA and their respective owners.

You acknowledge that JLA will report to law enforcement authorities any actions which may be considered illegal. When requested, JLA will cooperate fully with law enforcement agencies in any investigation of alleged illegal activity on the Internet.

If you violate these Terms, JLA reserves the right to terminate your ability to use the Site without notice. In addition, you agree to terminate your use of the Site upon request. JLA's preferred course of action is to advise you of your inappropriate behavior and recommend any necessary corrective action.

You agree that JLA may revise these Terms at any time without notice by updating this posting on the Site. You agree that your continued use of the Site after such modifications have been made constitutes your acceptance of such revised Terms.

Any action related to these Terms will be governed by North Carolina law and controlling U.S. federal law, without regard to the choice or conflicts of law provisions of any jurisdiction. You agree to submit to the jurisdiction of the courts located in Raleigh, North Carolina, for the resolution of all disputes arising from or related to these Terms and/or your use of the Site.
